Legal Question in Real Estate Law in Washington

washington state form 17

10 yrs ago I built a 6' high retaining wall out in the front yard to level it out. Later I found that I needed a permit if it execeeds 4' high. Now I want to sell house and am looking at ''form 17''. I don't see any place on it that would prompt me to have to disclose that the wall was not permitted, or am I wrong? There is a ''structural'' section, but it seems to apply to the actual house.(thanks in advance for any reply!)

If you failed to disclose the lack of the permit for the wall and the wall failed, and the failure impacted the house in some way, I think you could have a problem. If you were my client I would urge you to disclose it.

You can at this point go to Seattle's department of Land Use and ask for a retroactive permit for the wall. The fact that it has held for 10 years is encouraging, but withholding information about it now could become problematic.
