Legal Question in Traffic Law in Washington
Constitutionality of seatbelt law
In 2003 the seatbelt law was ruled unconstitutional by a judge in Snohomish county. Does that ruling still stand or was it appealed and turned over? Can a traffic ticket for not wearing a seatbelt be dismissed?

Re: Constitutionality of seatbelt law
The ruling of a trial court is persuasive authority to other courts. Therefore, the Court you are in front of may rule it unconstitutional, however, they do not have to rule it unconstitutional. I do not believe the Court of Appeals has addressed the issue yet. Good luck.
