Legal Question in Traffic Law in Washington
Cop used radar while driving the other direction
I was pulled over for going 58 in a 45. The cop was traveling the other direction did a u-turn and pulled me over. I was behind another car and when I told the cop I was behind the other car he said I clocked him at 50 and you were going 58. He asked if I wanted to see the radar and I said no. Do I have a leg to stand on?
If not can I request a diferement? I haven't had a ticket in 15 years.

Re: Cop used radar while driving the other direction
First, whether the cop coul dget your speed accurately depends upon a number of factors, th emost important of which is how far you were from the car in front of you. Modern radar can take multiple readings in a very short time and he might have been able to get your reading as well as the person infront of you. Was the road flat or hilly or curvy? Was there other traffic in front of the person in front of you or behind you? These are all factors thatbear upon the ability of the cop to get an accurate reading on you. A deferred finding is available once every seven years for a moving violation and for the same time for a non-moving, e.g., expired tabs, violation. Some courts do not do deferred findings so you best talk tosomeone like me who does extensive traffic work. Good Luck!
