brother missing for 12 years

How would we have missing brother declared legally dead in Washington state. If it makes a difference, he is Native American.

Washington law would determine the time that a person would have to be missing to allow for a determination that the person was dead. That period in Washington is 7 years. There may be applicable federal law on the distribution of the estate, e.g. the provisions of the American Indian Probate Reform Act.
