Legal Question in Wills and Trusts in Washington

Which Category of Will fShould my Mother to use?

My Mother has been married, divorced from my father, subsequently widowed, and subsequently divorced, legally changing her last name to her deceased second husband. She is single, but the WA will form for a single person with an adult child (I have no siblings) states ''who has never been married'', which does not apply. The form for a widow with an adult child states that the adult child is a product of the marriage to the deceased person, which does not apply. Can you help by steering us to the proper form? Thank you.

This is why I'm not a fan of forms -- they often don't fit the circumstances. The single form with adult child is the closest to what your mother needs. If the form can be altered I would suggest removing "who has never been married" and exchanging that with something like "who is widowed, her husband having predeceased her on ____" or something to that effect. I'm assuming there is no other reference in that will form to the deceased spouse or stepchildren. You might want to pay an attorney a fee to simply review the document before execution.

There is no pattern form for a will in WA. Contact your county Bar Assoc who can direct you to a lawyer who can draft the most appropriate document for your needs, and the other documents as well.
