Legal Question in Wills and Trusts in Washington

convert from living trust to conventional will

My wife and I have a 10 year old revocable living trust and would like to revert to a simple will. Will the notarized later date of will supplant the living trust conditions? We are attempting to simplify and avoid the trust's complexity.

Re: convert from living trust to conventional will

Assuming that the trust is revocable, and assuming that you properly transfer the assets out of the name of the trust, there shouldn't be a problem AS LONG AS the trust assets are transferred out of the trust. Any assets that remain in the name of the trust are governed by its provisions. Simply signing a new will in and of itself will not do that trick. I think you should seek at least one consultation with an attorney to review your work and/or to assist with the transfer of property.
