Creditor's claim

My brother passed away 12 Sep 2005. The Personal Representatives posted a ''Notice to Creditor's'' on 17 Oct 2005. I filed a Creditor's Claim and it was posted on the ''Superior Court Case Summary'' website for Snohomish County on 25 Jan 2006. The 4 month waiting period ended 17 Feb 2006. My question, is there a timeframe when the Personal Representatives are supposed to honor/pay the creditor's claim? If they do not pay, is there a deadline that I must meet if it becomes necessary for me to go to court to try and get the money listed in the creditor's claim? Thank you

Re: Creditor's claim

There is a deadline for filing a creditor's claim, but not a deadline for the PR to pay the claim, interestingly. When the PR is ready to close the estate they must be able to prove to the court that they have paid - or denied - all the creditor's claims. They will ask you to sign a document attesting that you have been paid, and then include that in the case file with the court.

Sometimes, even a diligent PR has stuff come up that prevents them from closing the estate in four months. However, so long as you filed your claim, it has to be addressed. You are entitled to notice from the PR as to what's going on.
