Legal Question in Wills and Trusts in Washington

Deceased fathers mineral rights

My brother living in Washington State had my fathers mineral rights transfered to his name when an oil company contacted him that they wanted to drill on our land. He has yet to add my name to the rights and tells me he will splitt any monies that come from the drilling. But being in the payroll industry I am concerned about the taxes. He dosen't seem to want to add my name. My mother is also deceased and we are the only two living. Can I force him to add me and who can help me?

Re: Deceased fathers mineral rights

An attorney should probably look at the documentation, including the Will, if any, of your father and mother. However, it sounds like you've got an equal right to the asset and should either be placed on the mineral rights deed or the asset should be sold and the proceeds divided equally. You should probably start with a demand to the brother. Any attorney can draft such a letter or you can try to do it yourself for starters.
