Legal Question in Wills and Trusts in Washington

Am I eligable for community property?

We have lived together for 20 years, and my paychecks were deposited into a joint checking account. The remaining accounts are in my partners name, and she has passed away. Her children feel they have rights to all of her accounts that were not ours jointly. We had not filed for domestic partnership, and were not married. Her will states that I get all tangible property, and that the kids get all intangible property. Can I contest this, and get money from her other accounts?

You can contest a will, but unless she had some mental defect or there was duress in the creation of the will your prospects of success are limited.

Re: Am I eligable for community property?

This is an interesting question. There are two ways I would attempt to get you all or some of those accounts. One depends upon the actual language in the will as you stated in your question and one would be through community property.

We regularly handle probate disputes if you would like further assistance.
