Legal Question in Wills and Trusts in Washington
Estate Reimbursement
I need to submit a reimbursement list against the portion of my father's estate that his widow was alotted. I have receipts and notes for everything, but am wondering if some type of checklist exists. A list of possible things that can be reimbursed, something I haven't thought of or didn't know I could request. She left the state and I was left handling the legal / financial side. It has been very difficult and I would like to make sure that my efforts and expenses will be thoroughly covered. Any help in this matter would be great. Thank you.

Re: Estate Reimbursement
The reimbursable expenses of the estate are expenses incurred in performing the actions or products that were specifically done or obtained to support the probate of the estate. They could be almost anything if it was required to probate the estate, but typically include, but are not limited to: filing fees, notary fees, clerk's letter fees copying costs, postage, mileage to and from court for filing and hearings (at standard rate), etc.
Re: Estate Reimbursement
No, there is not a form checklist.
Also, normally your fees whould come out of the estate proper, not the portion that belongs to one of the beneficiaries.
Is there a probate attorney? Have you just drawn up an accounting and submitted it as a creditor's claim? Thats probably the simplest way, rather than asking to be reimbursed out of a bequest.
If the widow owes you money it doesn't matter how she's going to pay it, if she owes it. You just ask her for payment, and never mind about where it is coming from. That's a basic contract problem, not an estate issue. If she doesn't pay you, then you sue her.
Hope this helps, Elizabeth Powell
