executor appointment

son died without power of attorney or will. children agree to have grand mother handle estate both real & personal. what forms need to have local court to approve appointment

To probate an intestate estate the first document you will need to file is an application for adjudication of intestacy (with a certified copy of the death certificate). The court will then sign an Order of Adjudication of Intestacy and Heirship, the appointed executor (often the applicant) then will sign an oath of EX _PR, to get letters issued by the clerk. This is the documentation to get started. You may also want to do a motion and order for non-intervention powers. You will also along the way need to do an Inventory and Appraisement, notices to creditors and eventually notice of completion of probate. There may be other documents required depending on circumstances.
