My father died and my step mother has everything, what are my rights?

My father and step mother had an agreement that when he died she would get the house and be able to live on the interest of the retirement fund until she dies. I would receive all of his personal posessions, tools, equipment etc. When she dies, I would receive the retirement fund and her children would receive the house and contents. The problem is, they live several hours away and I was not able to return to pick up the rest of his things for two months. She assured me everyting was safe and would not let anyone take anything. Several items were missing. Due to her behavior I am concerned that she will leave everything to her children and I will be left in the cold. Is there anything I can do to insure his retirement goes where he intended?

It is unclear from your question what type of arrangement your father and stepmother had. Did your father have a will that specifically made this arrangement? Did he list specific beneficiaries in his retirement accounts apart from his wife?

I suggest you meet with an attorney at least initially who can review the relavent documents or at least steer you towards what you should be looking for or requesting from your stepmother. An initial consultation might run you around $100, but obviously depends on what attorney you see and where.
