My father left no will

My father recently passed away and left no will. He was married and his wife wants me to sign a ''quit claim deed'' which apparently releases my portion of interest in the house they owned together. Am I entitled to any monies or percentage of the house ? And how do I go about filing a claim to his estate ?

The other attorney is quite correct. There has to be a more in-depth investigation into who acquired what property and when, whose names are on the title, etc. You really need to see an attorney and DO NOT SIGN ANYTHING unless you have advised by an attorney. DO NOT WAIT TOO LONG - there is a creditor's claim period of four months after the notice to creditors is filed and first published within which a claim must be brought or the claim will be forever barrd! You should act immediately!

You are entitled to an interest in his separate property (probably 1/4) but probably not his community property. So, an important question is whether he owned the house prior to his second marriage. I'm sure you're expecting this response but substantial property interests may be at stake -- you really should meet with a probate attorney to discuss your rights. An attorney would assist you in filing a claim and determining what you are actually entitled to. DON'T SIGN ANYTHING until you discuss these issues with a competent attorney.
