Re: living wills

First off: Please accept my condolences on your recent loss.

A living will is not the same as a will. A living will is about end-of-life issues, not the transfer of real property. You don't say whether your father had a will, or not.

You are a beneficiary of your father's estate; you are entitled to know what will happen to his estate, and entitled to a portion of his estate (although your mother takes first). Depending on several factors, you may have to wait for your mother to die before you and your brother are entitled to take anything, and as she owns his property now she can sell it.

Or, you may be elgible for a distribution of a portion of his separate property now.

You really need to spend a few minutes talking to a local lawyer. That person can help you figure out how to proceed now.

Hope this helps. Elizabeth Powell
