Legal Question in Wills and Trusts in Washington
Locating a Trust
My grandmother informed me years ago (my parents are divorced) that my grandfather set up a trust before his death (1960s)that named my father as one of the beneficiaries. If my father preceded his mother in death than the beneficiary became his children (me and a brother) Which happened. Distribution would be triggered by my grandmothers death. Grandma has recently passed away and no one seems to know about this trust. The will does not mention it, the bank knows nothing and the executors know nothing. Where do I go next?

Tough question. Try to talk to the lawyers who did work for your grandfather years ago. May be the same lawyers working on your grandmother's estate. Sounds like a remainder interest for your father [in turn you and brother] after grandmother passes away. If grandmoither only had a life estate, then your interest would have vested when grandfather passed, but if not vested, then, grandmother could have changed the trust or did a whole new will. If she has passed, you may never know. Who are the heirs now of her estate? And who is the executor related to? Try to find someone who can give you straight or disinterested answers. But it is hard to do. Good luck.

Check the county recorder's office.
