Legal Question in Wills and Trusts in Washington

My mother left her property in Ohio as a Life Estate to my stepfather, with the home to go to myself and siblings when he dies. He moved out a week after the funeral to another town in southern Ohio. Does this mean he is declining the Life Estate? If not, who is responsible for the taxes and bills on the property?

Typically, a life estate in a residence lasts only as long as it is used as the principal residence of the beneficiary. You will have to consult the document that establishes the life estate to see how it defines the events that end the life estate. So long as the life estate exists, the beneficiary is typically responsible for the costs of maintaining the property and from losses for failure to do so.
