Legal Question in Wills and Trusts in Washington

My Mother passed away on July 2nd in the State of Washington and my stepfather is refusing to show a copy of the will to my sister and I. He says he doesn't have to because it's his will, too and he doesn't want us to see his confidential information. What are my legal rights in this situation?

Dear 98119,

Condolences on the passing of your Mother. A person holding a Will of a deceased person has 40 days to file the Will in Superior Court, regardless if probate is opened. If no Will is filed 40 days after your mother's death, you can request the court to compel your Step-Father to produce the Will.

More information regarding probates can be found on my website: suissalaw.com.

Sincerely,

Caroline R. Suissa-Edmiston, LL.M.
