Is it neccesary to go through Probate on a small estate?

My mother passed away and left my husband & I as executors. She left her home to her adult grandson. The home is valued at approx. $40,000.00 & she doesn't have other assests. She did leave some outstanding debts. We can't afford legal expenses, so can we handle this ourselves?

Unfortunately, probate is probably necessary. You can count on a simple probate like this costing upwards of $1,000. You can also do it yourself. But it will be time consuming and there may be mistakes along the way. The small estate affidavit, an alternative to probate, does not apply to real property.
