Legal Question in Wills and Trusts in Washington

Parents Divorced 1983, Father passed away in NC 2003.

His name is still on my Mother's property as ''Joint Tenants in Common'' in WA state. My Sister Mom and I just want to remove it. When he passed, there was a probate opened so he could be buried. It was closed a year later in 2004. We were never contacted and are now left with the title to the property tied up. How do we get his name off the deed?

Was there a decree passing the house to your mother? If so, an Affidavit of explanation may be enough for a title company to clear title. I suggest you check on that as well as your father's will and consult with a probate attorney.
