Can a person named in a Will, who is given 70% of all the assets of the deceased (or any percentage) voluntarily give that 70% back to the estate.

Yes, but the person has to "disclaim" the assets before ever having control over them or it will be considered a gift from the person and subject to the Gift Tax.
