Power of Attorney
My father, who is in a nursing home in Vancouver, WA, has dementia. I live in San Diego, CA. He had given Power of Attorney to a ''friend'' of his who lives in Vancouver. This was done without my knowledge. He was living with these people, who were taking care of him. When her husband became ill, she put my dad into a nursing home. I do not trust her. What would I need to do in order to have that Power of Attorney turned over to me, his only child? I would like to move my dad to a nursing home in San Diego, where I could be with him. I think his family should be taking care of him, & not some so-called ''friend''. She won't even give me updates on his condition, & I can't afford to fly up there all the time. His memory is very, very bad. I'm afraid when he dies, she won't even let me know. I can't afford an attorney.

You can go to Vancouver and petition the court to make you conservator of your father's body and estate. Once that is done, if that is done, you can move him to San Diego and continue the conservatorship there. Otherwise, the power of attorney will remain good, assuming it is a durable power of attorney. If it is not a durable power, it is no good now, and getting a conservatorship established will be easier.

As to the attorney, you will likely not be successful without one. But, if you get a conservatorship established the attorneys fees will ultimately be paid out of your father's estate.
