Legal Question in Wills and Trusts in Washington
probate/wills
my father died in feb. 2007. his third wife said he had no will. now we are taking her to court and she is saying she has a will with one signature. he died in az. and I was told in az. this is acceptable. He elived in az.in the winter and died there but he voted in wash st. and had a licence in wash. so his legal resident was wash. She has forged her fathers will and we don't know what to expect. can the judge accept this will from az state.

Re: probate/wills
Sounds as though the AZ will is suspect, given her history of doing this before.
Did he leave real property? Where was the real property located? If he had no real property, is there another basis to do a full probate?
If he didn't have a valid will, he didn't have a will, and chances are you will take more of his estate if there is no will.
I certainly hope you got a lawyer to help you with this. You need one.
The judge will review the AZ will to see if it is acceptable under WA law and either will or will not admit it to probate.
If there are no witnesses chances are it will not be valid here.
Challenging the will on the basis it was forged is a whole other problem.
