Legal Question in Wills and Trusts in Washington
Settling my parents estate
My sister was left in charge of my parents estate. 3 years after, the house is not cleared out, vehicles not sold, still paying for phone at the empty house not to mention insurance, property taxes... My brother and I offered to help her clean out the house and get things moving but she refused to let us help her and insisted she do it all on her own. With the bad economy we are only getting half the price for the house as we would have 3 years ago not to mention all the money she is throwing away on unnessisary expences. My question is, can we ''sue'' my sister for the amount she has wasted over the past 3 years. That amount would come out of her share of the estate money and be divided between my brother and I. I do realize this would tear up the family but she has already done this with the poor handling of the estate.

You can force an accounting by the administrator/executor. You can move to replace the administrator/executor. Some of the costs of poor management could be put back on the administrator/executor. I will tell you what you already know, that if you can resolve this without a major confrontation that would be better for future family relationships, how you do that is the challenge.
