Legal Question in Wills and Trusts in Washington

My step father passed away in California and my mom is a 24 hour care nursing home unable to care for herself. I currently live in Washington State. I want to get a guardianship (or conservatorship) for my mother. My step father did not have a will, has a home that has been auctioned off. My mom is being taken care of through MediCal benefits 100%. I am in the process of getting her transferred up to Washington State and her benefits possibly transferred. I wanted to get a durable power of attorney, but since she is unable to talk I can't, due to that action being against the law, i believe. My step father also left behind a large life insurance policy with no beneficiary assigned and a retirement benefits as well. Without a durable power of attorney I cannot help my mom claim any of these benefits and I've been told I need to appoint a guardianship.

I would like to know what my options are and if I could utilize medical, or social security to help pay for the legal fee's of a Durable POA and/or guardianship.

I was under the impression that I had to hire a guardianship to help me get a durable power of attorney. I was told today that I have to have one or the other.
