Legal Question in Wills and Trusts in Washington

Do we need to update a trust?

We established a trust in California two years ago. We moved to Redmond, Washington a year ago. Do we need to update the trust to reflect our new location?

Re: Do we need to update a trust?

The Trust is probably okay as is but I really can't verify this without reviewing the document. You should have an attorney verify the language of the document. Also, a trust is only as good as the property that is properly transferred into it. If you moved from California and purchased property or opened account here in Washington, the owner of those assets must be the trust (or more accurately, the Trustee of the trust). It is not enough to simply list those assets in the trust Schedule. The trustee must be identified on the deed or account.

Regardless, you should probably update your pour-over wills that accompany the trust to reflect Washington law. Ditto with respect to any Power of Attorney or Living Will. Again, perhaps a review by a competent Attorney will suffice.
