Legal Question in Wills and Trusts in Washington

Can you wife be the Executor to your will..she is the primary beneficiarry

In the state of WA, can my wife be the Executor of my will?

She is the sole beneficiary if I should die before her.

I would like to name her the Executor if I can.

Many thanks

She sure can. This is very typical of estate plans, especially if all of your assets are pretty much held jointly/equally as community property. However, if you are not leaving everything to your spouse and/or your have significant separate property assets, you may wish to reconsider such a selection as there may be a conflict of interest. However, there would still be nothing preventing you from naming your spouse as executor.

Simple answer: Yes, she can be your Personal representative (the term WA uses for executor, etc.)

However, the state of WA also allows a Community Property Agreement. If she is your sole beneficiary, a Comm. Prop. Agmt. would pass everything immediately on death without the need for the expense and time of probate.
