my mom passed away june 15 2009. The original will had my sister and I as executors of the will. My sister now tell me that my mom changed the will 6 months ago and that she gets everything, the original will had us splitting everything.The total estate is only worth about 150,000.00 is it even worth me contesting the will?

In order to contest a will, you have to show one of the following: that it was a forgery, that your mother did not have legal capacity to make a will (that she was incompetent), that someone unduly influenced her to make the new will, that she was coerced into making the new will, or that the new will was not validly executed.

Beware: you may only have 4 months from the date the probate was opened to contest the will.

If you think that there was a valid reason for your mother to disinherit you, then it is possibly not cost effective.

But if you can think of no other reason other than your sister applied undue influence or that your mother was not competent enough to make a will six months ago, $75,000 is a lot of money to walk away from.
