Legal Question in Wills and Trusts in Washington

Hi,

I have a pretty simple (I think) legal question. My husband had his will done before he deployed for Iraq and it specifically and completely disinherits his older brother from his will. I have also done a basic will online but it did not have a provision to disinherit anyone. I am wondering since WA is a community property state whether his brother could have any claim to my (or our estate) if I do not also specifically disinherit him in my will. I would appreciate any advice that you can give.

Community property only operates between spouses and now in form at least between domestic partners (with registration). You don't need to say anything specific about who you don't want to get a share of your estate (unless you have a person who would otherwise be an heir). The precise (legal) meaning of heir is a person who would take under intestate (no will) rules.
