Legal Question in Wills and Trusts in Washington

wills

Father and mother signed over house to brother and diabled daughter. Father gave mother right to live in house until deceased and cannot sell house three years ago and I am wondering if my brother can get the house he has a power of attorney to pay my mothers bills as she tells him like lights food etc.

They live in Wisconsin I live in Washington state. Can he gain the full ownership?

Thank you Barbara

Re: wills

First off, as the real property at question is in Wisconsin, you need to ask a Wisconsin atty for advice - my opinion isn't going to count if they have different rules there.

That said, if the house were located here, your father has created a "life estate" for his wife. I'd need to know whether your father has died or not - sounds like his plan was the house would go to your brother after both your parents died. If your brother has DPOA, he essentially has control of the house right now. He will gain full ownership once she is gone. ANd it depends on what the DPOA says, of course.

Please be sure you are getting an accurate answer by posting so your question will get answered by an atty in Wisconsin - hope this helps - Powell
