Legal Question in Wills and Trusts in Washington

Both my parents have passed away, my mom died 04-28-2007 she had a will. I have 3 sisters and 2 brothers that are named in the will. At the time of her death she had about $50,000.00 in her savings however that is gone. But she had property in Tumwater,WA that is worth about $300,000.00 the will states that the property (which she owned free and clear) is to be sold and the money divided amongst the 6 of us. So far nothing has been done her will hasn't been filed and I'm in need of a home since I became homeless recently. What can I do to speed up the process (I don't talk to my sisters).

As you will see in most responses on this site, I suggest you consult with an attorney. Have you read the will? Who is named as Personal Representative (Executor)? That individual should hire an attorney to get the process started. If they refuse to do so you can take action to speed things up.

While you may not wish to hear it I would suggest you start talking to your sisters, or at least the one or more named as Executor at the very least, so that you at least have an understanding of their timeline in administering the estate.

Once the sister named as Executor, if that is the case, has hired an attorney, the estate administration typically takes only a matter of a few months to complete, sometimes faster depending on the circumstances.

You must mean April 2006. First off, please accept my sympathy on your loss.

You need to locate the will and get it filed. If the money disappeared from her savings after she died, somebody is going to have to account for those funds, as they cannot belong to anybody else (unless she'd set up a JTROS account with somebody).

Are you the PR of her will? If not, you can demand the PR file the will and open the probate, and if you are the PR, you can get the process started.

If you need more assistance, contact your local Bar Association for a referral to an attorney who handles probate work.
