Legal Question in Wills and Trusts in Washington

Who Can Write My Will

I am wanting to have my will made up. I was wondering if I have to use an attorney within the same state as I live in or if I can use an attorney within a different state.

I do not believe there is an actual legal requirement that your Will must be drawn by an attorney in your state. This is usually recommended, however, so that you are assured that the attorney preparing your Will is familiar with the legal requirements of your state for valid Wills, as well as any particular conventions for expressing certain wishes in a way that would be enforced by the courts when the Will is offered for probate following death of the Will maker.

I agree with the previous response. I would only add that you may also have difficulty finding an attorney in the state in which you do not reside that is willing to draft a will for you. There may be malpractice issues at stake for that attorney.
