Legal Question in Workers Comp in Washington
Tendonitis in hand from job.
I have tendonitis in my left hand from repetitive motion at my job. I have seen a occupational health doctor and a specialist and have been to physical therapy. I still have pain and it appears that I may never be able to use my left hand to work again. My work resently went from five 8 hr.days to three 12 hr.days with three 15 min.breaks and no lunch. (we signed a paper that we had the option of giving up our lunches)Can I sue my company for compensation and how would I do that with out the money for a retainer.

If you are in a union you should talk to them about the change in hours. My guess is you are not in a union. But if you are then the union may have agreed to the new hours. As to your hand, most lawyers who do Workers' Compensation do not charge a retainer. They work for a percentage of what is collected. I don't know what the rates are in your state but don't be afraid to call an experienced Work Comp lawyer and see him. You may be surprised at what is available.
You might also make a request for an accomodation under the ADA act. Your employer MAY be required to adjust the hours to suit your endurance level. Also your state laws may allow for a retraining but you don't say how old you are. These rights, if they exist in your state, may be more difficult to obtain the older you are. Good Luck.
