Legal Question in Workers Comp in Washington

termination

I am a fed worker and currently have a claim for stress filed with owcp. I have received a letter from my employer demanding my return to full duty by oct 1 2001 and all further lwop is denied regardless of the reason. If I remain absent beyond oct 1 2001 I will be carried awol and actions to terminated my employment will be taken. My stress claim is pending with owcp and I have full support of my doctors in this matter this is the 2 nd threatening letter i have received from this employer trying to terminate me . The last letter was recended and I was given a written apology for there mistake. Do I let them fire me or try to fight it ?

Sorry I did not respond to this earlier, the alert on my email just came through this morning. Two things. First, contact an attorney that does OWCP claims. My specialty is Washington state worker's comp claims. Try John Goodman in Seattle. Second, if you are terminated for AWOL when you are on doctor's orders not to return to work, you may have a defense through the Merit Systems Protection Board. Any adverse employment action must be appealed in writing within a few weeks, so if this has happenned, don't delay contesting the decision. Again, you will need an attorney who specializes in this type of federal case. Best of luck - Paul Bryan
