Legal Question in Banking Law in West Virginia
Unreimbursed funds due to check forgery
Approximately one month ago my son wrote a check for $1000.00 to put as a down payment for a car. The check bounced due to insufficient funds. When we went to the bank to see why this occurred since he had sufficient funds available we were told he wrote a check for $1500.00 to an individual. When asked about this he denied it and we requested a copy of the check. Upon receipt of the check copy it became evident a forgery took place and this was seen by the bank manager as well. A police report was done along with an investigation and the individual responsible admitted to the action. According to the bank manager the teller should have verified the signature prior to disbursing any funds but she failed to do so. Now my son is still out this money and the dealership is understandably angry about not being paid. The bank manager keeps telling me the corporate office ''isn't returning his email'' so he can reimburse my son. It appears the bank is stalling for time and is refusing to settle this. What can be done legally about this issue.

You may wish to have an attorney intervene.
Call or e=mail for assistance. The bank is clearly on the hook for this.
