The most that can be said is that a married couple is eligible to file a joint bankruptcy with some cost savings even though they are separated and intend to divorce. If there is a separate filing, a spouse who ends up paying more than his or her fair share as per the divorce agreement can go in to the bankruptcy court to complain about the inequity.
