Legal Question in Bankruptcy in West Virginia
Bankruptcy and Pay Day Advance
My daughter is considering filing bankruptcy due to credit card debt. In order to keep her head above water, she has for about a year had two pay day loans--you know the kind where they hold your personal check for 14 days or pay day. She keeps renewing the loan by borrowing the money again. Is she able to claim these debts in bankruptcy since they can run her personal check through the bank?

Re: Bankruptcy and Pay Day Advance
I believe that the pay day loans would be dischargeable.
