Legal Question in Bankruptcy in West Virginia

filing chapter 7

Can you file chapter 7 in a different state other than the one you live in? If so, how would be the best way to go about doing so?

Re: filing chapter 7

You can file Ch. 7 where you reside, maintain your domicile, where your principal assets in the US are located, or where your principal place of business is located (place of business is not synonymouys with place of employment -- you have to have a business), or where a related bankruptcy case is pending. For most consumer debtors, this means you can only file where you live. In any event, the only exemptions available are those for the Debtor's domicile, so you can't forum-shop for the best exemptions.
