Legal Question in Bankruptcy in West Virginia

married and filing seperatly

I was sole prop of my own business..credit cards are behind because business failed...husband thinks i should not file bankrupcy because our joint assets will be affected..because of comm prop law in wv..will my husband's assets be affected? the credit card companys are harassing me and i need relief. my husbands income is all i have...and together own our home and business building ( which is leased for bank payment)

You need to consult with a lawyer who can go over all the facts of your situation with you, face to face. Perhaps a Cahpter 13 would help you, but no lawyer can answer that without analyzing all your circumstances - which is just not possible over the internet.

If you can't afford a lawyer, ask Legal Aid for help. Most bar associations also have panels of lawyers will to work for reduced fees.
