Legal Question in Constitutional Law in West Virginia

question concerning the media

Can a local newspaper disclose information about a person who is moving out of town and announce where he is going. My husband is a pastor and it was announced in paper before he could tell congregation. Can a newspaper legally do this? We gave no info or consent.

Re: question concerning the media

I don't see anything illegal about what the newspaper did. The news media doesn't need permission to before it can run a story, nor does it need to get the information from the person it is reporting about.

Your question implies that the report was accurate, so it was not defamatory. The fact of your husband's move seems newsworthy within your community, and I don't think anyone's privacy has been invaded. Your husband's interest in being the one to tell his congregation is not one the law will protect, especially against a newspaper acting within its First Amendment rights.

Re: question concerning the media

Yes the newspaper can legally publish such information without your consent unless it is false information.

No statute creates any "privacy rights" which would be applicable to moving or changing jobs in this context.
