Legal Question in Consumer Law in West Virginia

Refrigerator

I got a new refrigerator in Nov. of 2006. Before the end of the month it had stopped working and needed repaired. In December it stopped working and needed repaired. In Feb. 2007 it stopped working and needed repaired. It now has stopped working again. The retailer says it is not responsible. The manufacturer has refused to replace it. I am without adequate refrigeration at home. Is there anything that can be done? Refrigerator is only 6 months old and still under warranty.

Re: Refrigerator

You can file a complaint with the state, and consider taking the seller/manufacturer to court for failure to honor the warranty. There as probably a repair/replace clause and at some point, attempts to repair will fail.

Get a local lawyer familiar with warranty litigation and the state version of the Uniform Commercial Code.
