Legal Question in Criminal Law in West Virginia

Contributing to the delinquency of a minor

I recently allowed a 16 yr. old friend of my son to stay the night after running away from home. He was afraid to return home due to his fathers violent behavior. I assured the boy's mother that he was safe, and thought it best to let things cool down. The following day, I explained the situation to the boy's mother. She has now had me charged with contributing to the delinquency of a minor. Was the boy committing a crime by running away? Did I commit a crime by letting him stay?

Re: Contributing to the delinquency of a minor

The boy may have committed a juvenile infraction by running away, but the penalty for a first offense is a warning.

It is difficult to believe any court would entertain charges against you under the circumstances you describe. Providing shelter for a troubled teen, if found to be a criminal act, would render the law a laughing stock.

Consult a criminal lawyer in your area or the public defender.
