Legal Question in Criminal Law in West Virginia
Extradition of juvenile (now adult) for crime as juvenile
A female juvenile was never arrested and was relieved of approximately two and one half pounds of marijuana by the local law enforcement. The female is now an adult and is being charged with the possession of the marijuana. The initial confiscation occured as the female (then a juvenile) was leaving a domestic disturbance situation that involved the juvenile's mother and her boyfriend at the time of occurence. If the juvenile that has since became an adult chooses to leave the state of West Virginia pre-indictment will the state be permitted to extradite her from Ohio or any other state.

If they are able to obtain a felony indictment - yes they will extradite.
