Legal Question in Discrimination Law in West Virginia

Interview questions gender discrimination?

I had an interview for a pharmacuetical sales position (by an African American unmarried woman with no children - she made certain to tell me that I would be reporting directly to her and that she felt being a parent right now would make her ineffective in her work). The first thing discussed was my affiliation with youth organizations to which I was questioned - that must mean you have children? The interviewer proceeded to tell me that the position was open right now because one woman decided she couldn't handle the position with children and another was on maternity leave. Then I was informed of the intensity of the position and that I would have to be gone for ten weeks for training and she didn't see how I could do that as a single parent. Again, the interviewer told me that pharmaceutical sales was a demanding position which required many hours (and after hours work). I reiterated my ability to work, go to school full time (subsequently even attaining a master's degree), and be a single parent had clearly been displayed in my resume with much success. I did not get the job. An African American male got the job. Is there substantial gender discrimination for me to pursue any action?

Re: Interview questions gender discrimination?

You haven't identified your ethnica background, so I'll assume you're not African-American.

What you have is definitely a problem with gender discrimination, but it's not clear that the man didn't have children. The problem comes in with the fact that the woman went on and on about NOT having children as being a problem on the job. It was highly inappropriate.

Consult a local attorney, but essentially you need to file your claim with the EEOC on the basis not only of gender, but ethnicity as well, again assuming you're not of identifiable African descent.
