Legal Question in Discrimination Law in West Virginia
How do you prove age discrimination
I have went to several recruitment meetings of a east coast class 1 railroad and have been passed over for younger non-experienced people. I have 25 years experience in the railroad industry and they always pass me over for people in their twenties or early thirties with no experience. Could I prove that they are discriminating against my age?
Thank you

Re: How do you prove age discrimination
You can prove age discrimination by showing that a particular employer passed you over in favor of a younger employee that has less-experience and/or qualifications than you possess. Most hiring discrimination cases are fairly difficult in that it is difficult to state exactly what the qualifications are on the front end that are deficient in the younger worker.
If you believe that you have been discriminated against, I would recommend that you contact an attorney who handles labor/employment law matters regularly.
