Eh...you can divorce your wife and let him have her officially.

He's not breaking the family trust, she is. And, rather than think about punishing either one, why not just admit things are not the way you want/need them to be [which lead her to being open to adultery in the first place], and maybe it's best to let everyone move on.

Family counseling...open, non-judgmental family counseling...might heal your marriage, but the days are over in which the legal perception is that a third party is "breaking up a marriage." In some states it is taken into account, but most states it boils down to a matter child custody and property division.
