Child custody laws in wv

non married couple, if father signs over parental rights and does not have to pay child support would he have any custodial rights? How can I get another judge when I have been told by the person I am fighting that he has the judge in his hip pocket and I have requested a new judge and presiding judge refuses.

Your question is more complicated than a yes/no can handle. Talk with a lawyer. Call your state bar or local legal services office if you can't afford a lawyer.

About "I have the judge in my hip pocket:" I had forgotten this one in the list of things a bully will say. The others include threatening to bring in a stream of witnesses to testify that you're a slut, an alcoholic, an addict, an abusive parent, an abusive partner, you're crazy. I'll get the kids and you'll never see them again. I'll get the house and you'll be out in the street."

That'll do it, I think. Each bully has his or her own style, so you can add their variations to the list. Remember that very few judges like to be reversed on appeal. They will make good rulings because their rulings are memorialized in printed case law forever.

When you find a lawyer to consult, and if your judge truly is in somebody's hip pocket, ask the lawyer if you can file a motion for substitution of judge.
