Child Support after age 18
My son turned 18 in March and now wants to pursue child support from his biological father to help with college. After my son was born, his birth father made it very clear that he did not want anything to do with either of us. I was only 18 and did not want to cause any problems for anyone so I did not pursue any kind of support. I have managed to raise him on my own and have not been in contact with his birth father since my son was about three months old. I am not sure what the current regulations are concerning child support and can not find any information that pertains to this type of situation. Does my son have any rights, after age 18, to receive support? Will the fact that I did not pursue support, before his 18 birthday, eliminate any legal claim of paternity or child support? Is there any type of legal statute that addresses child support awarded after the age of 18, if there was no claim against the parent before the child turned 18? I do not know if this information would be of any value but we reside part-time in West Virginia and part-time in North Carolina. Also, my son's birth father is a doctor in Ohio.

Your son has no right to claim support as under the prevailing guidelines child support terminates when the child reach 18 years of age. It is advisable to consult the attorney in this regard.
