Legal Question in Family Law in West Virginia
child's name change
My son has joint custody of his son. He is going to war and he wants to make sure that if something happens to him, that his ex-wife will never be able to change his sons last name. Can she ever change his son's last name?

Re: child's name change
Yes, of course, the mother of the boy could petition the court to change her son's surname. However, once attaining his majority, the boy could petition to change it back to what it was during his minority, if he so chose.
