Legal Question in Family Law in West Virginia

Credit History

If a wife has excellent credit, and a husband horrible, can his credit history affect hers in ANY way? We have never combined names on loans, credit cards or even on tax returns. We don't even have a joint checking account. I own the home and is in my name only (before we were ever married). Could he ever try to go after what I have accomplished should we ever divorce? Thank you.

Re: Credit History

Yes. Your husband would have grounds for claiming "his" interest in your property and assets.

Notwithstanding the fact that NY "used to be called a Title State." All property acquired, or increased in value, during a marriage is presumed to be marital property.

However, the nontitled party would be required to prove their direct or indirect contribution to the acquisition or increased value of the asset; and you would also be entitled to claim your interest in his assets.

GOOD LUCK,
