Legal Question in Family Law in West Virginia

Can custody be changed after one parent has total custody?

I need to know if custody can be transferred to my mother. I am currently in the custody of my father and quite miserable. We had an agreement that I could be emancipated, if I got all ''A''s in school. That isn't really possible for me. I want to move to West Virginia to live with my aunt. My father says he will not let me go until I am 18 if I don't raise my grades. If I stay here I will die, there is no way I can live another year here. Please help.

It would be up to your noncustodial parent to petition the court to modify custody. Otherwise, you must wait until you are an adult on your 18th birthday.
